This Agreement and Contract specifies the services of Foamalicious to provide foam and/or entertainment services for the event specified and described in full on the Job Order/Invoice, to be supplied by Foamalicious. This Agreement, Contract and Job Order for the services, between the undersigned “Client” and Foamalicious Inc. Client also understands that foam, by nature is wet, and can cause any surface, it comes into contact with to be more slippery than when dry. Client understands that Foamalicious will maintain foam at a level that is age appropriate for the smallest participate and that Foamalicious may specify a limit on the number of participants at any one time, should the need arise for safety purposes.

This document is an offer and not a valid Contract until a deposit and/or balance is received. Contract must be signed with NO unauthorized changes.  Any changes must be approved by Foamalicious.

  1. Deposit is 30% of total package price, unless otherwise noted on Job Order. Balance is due 21 business days prior to event date. Failure to comply may forfeit all discounts/deposits.  Checks will only be allowed 21 business days prior to event. Any balances must be paid in cash when Foamalicious crew arrives and prior to setup, unless otherwise noted on Job Order by Foamalicious. We do NOT accept net 30 payments. 
  2. In the event of cancellation, Foamalicious may withhold part or all of the deposit for holding your date and expenses that may have incurred. All cancellations must be in writing via Email to info@foamalicious.com. Only Contract signer may cancel Reservation/Booking.   

Cancellation Policy:

-Prior to six (6) months before the event: 1/2 of the deposit will be refunded    

-Six (6) months to 121 days prior to event: 1/4 of the deposit will be refunded

-120 days prior to event: no refund (no exceptions)

(Refund process is approx. 30 - 60 days.)   

  1. Client agrees to provide from 4 up to 16 dedicated, 110V (15amp or higher) electrical outlets within 50 ft. of Foamalicious station setup area with an earth grounding receptacle and a Ground Fault Circuit Interrupt (GFCI) or heavy-duty Generator(s) to handle needed power. (Depending on size of package and to be discussed 7 days prior to event) Failure to comply with power requirements will result in lack of foam production and/or power outages. Foamalicious will NOT be responsible for loss of show because of lack of power.
  2. Client will provide a constant clean water source at no more than 50 ft. of Foamalicious station setup area. (Please Note – certain water softeners, city water, well water may act like a de-foamer and will not be conducive to good foam production).
  3. Client further agrees they will provide representatives/chaperons/adults to be present to maintain order and safety. Foamalicious will NOT act as safety or security and Client will solely be responsible for their event. Should the event have problems of security or safety Foamalicious will notify client, one time of the matter, and if it is not resolved Foamalicious may stop event with no refunds offered. Client must notify patrons/guests of no running, pushing, jumping, people standing on others shoulders and NO jumping over the foam pit.  
  4. Foamalicious, its owners and operators, shall not be liable for any claims at law or equity arising out its presence at the event location address, unless such claims result from negligence or willful misconduct of Foamalicious, its owners, operators or agent. If any action of law or equity is necessary to interpret or enforce this agreement, the prevailing party shall be entitling to reasonable attorney fees and costs. But before attorneys are involved, both parties agree to go to arbitration/mediation first, with the mediator fees to be split by both parties.
  5. Foamalicious requires a smooth, flat, roll-able surface. If your location requires the transporting of equipment up or down stairs or steps, grass, dirt, etc. it must be stated on the contract, due to the extra time and/or help required to safely move the equipment. An additional fee WILL be added to reservation.  
  6. Long distance travel will require mileage and/or hotel fees with no exceptions. All travel expenses are due at time of signing. Due to gas price fluctuations, you may be required to pay additional for gas surcharges. Client will be notified of this change with a new invoice. Once Foamalicious crew has left to event/party location NO REFUNDS will be offered. (Please refer to #2 above.)  
  7. Foamalicious is always happy to setup at outdoor sunny locations, as long as ample shading/tent is provided for Foamalicious equipment and crew. (Refer to #3 & #4 above.) 
  8. Foamalicious will NOT setup in rain, lightning, thunderstorms or weather that can cause damage and or harm to Foamalicious equipment, operators and guests. Client agrees to protect Foamalicious and equipment in case of bad inclement weather by providing tents, coverings, or moving to a safe location. Foamalicious will NOT be responsible for loss of show time due to client not creating a safe environment as stated above.  
  9. Once the Foamalicious Show has been setup it CANNOT be moved. Please choose location wisely and prior to event date. Foamalicious Crew many offer a better location upon arrival. 
  10. All indoor events may incur an additional cost and must notify office 14 business days prior to Foamalicious crew traveling to event. Foamalicious is NOT responsible for removing left over foam/water at indoor locations. Foamalicious is NOT responsible for any damage to flooring of indoor locations. We do not recommend hardwood or tile floors. 
  11. Grass and dirt locations: While our foam solution is 100% Toxic Free, water on locations such as grass or dirt can create massive mud. Foamalicious must be notified of these locations to plan accordingly. We may impose an additional clean up fee for the foam pit and equipment. 
  12. Should an event run over the time specified on the job order, overtime will be paid at the time of the event. Client will be liable to pay overtime according to the hourly amount currently charged by Foamalicious. Overtime is payable at the event to FOAMALICIOUS.
  13. While we do our best to make your party fabulous it will be understood by the Client that live parties are subject to unforeseen circumstances. (Examples; blackouts, equipment, dysfunction, static, etc.) Therefore, a certain amount of flexibility is expected of the Client. Foamalicious will have the SOLE and FINAL decision on safety and cancellations due to inclement weather or unsafe activity area.
  14. Should a Client use a payment method that Foamalicious is incapable of collecting the funds (e.g. bounced check, fraud money, and bad money orders) Client shall be legally responsible to all funds plus all fees. Shall this collection of the funds continue forward in a court to collect those funds, client WILL be responsible for entire amount plus court and attorney fees and 5 times the totally amount as restitution.
  15. Sponsorship discount requirements: See Below  
  16. Non Foamalicious DJ(s) must announce FOAMALICIOUS.COM throughout the event, at least once every 15 minutes, to the entire club, school, event over PA, mic, loudspeakers, etc.
  17. Music requests for DJ packages must be submitted 7 business days prior to event. 
  18. While Foamalicious carries an insurance policy for its services, while its operators are on site, we still require that Client maintains a policy of insurance covering injury to persons and property occurring at Event location.
  19. We do NOT issue certificates, COI's, until we have received signed Foamalicious contracts and a deposit has been made. 
  20. Any last minute (48 hours before event date), additional riders, COI's, to Clients location/party/event MAYBE issued at an additional fee of $175-$799.  

The undersigned accepts the terms and conditions on this form and the Job Order, and any addendums attached hereto, realizing that they accept liability for any injuries or accidents that many occur during the Foamalicious event. Further, the undersigned acknowledges that this agreement and Job Order constitute the entire agreement for the parties

 

Sponsorship Agreement

This agreement is between Foamalicious Inc., and Client.

TERMS OF AGREEMENT:  Client agrees to grant Foamalicious the following sponsorship rights:

  • Client can use Foamalicious trademark logo for all forms of promotions for event held on date listed above without risk of Trademark infringement.
  • Client can use Foamalicious videos but will not alter or modify videos in any form or fashion.
  • Client can utilize any of the Foamalicious social links to help promote said event only by permission from Foamalicious owner and/or manager.
  • Client will have Emcee, MC, DJ, Radio Station or speaker announce “foam sponsored by Foamalicious.com” throughout the entire event over PA, Loudspeakers, radio, TV, etc.
  • Client will list Foamalicious on all their social media sites.
  • Client will place a link from their website domain(s) to Foamalicious.com for duration of no less than 1 (one year).
  • Client and all sub-contractors, promotional teams, and photographers use of the Foamalicious logo to be used on all materials for event to include but not limited to hashtags, #Foamalicious, likes, adds, shout outs, @Foamalicious, friend requests, etc.
  • Client will email Foamalicious an approved flier/banner for event.

For the sponsorship discount(s), listed above are the requirements. Failure to comply with listed requirements will disqualify you from any/all discounts as stated on the forms and will be applied to balance and must be paid prior to event date.
