Renter understands that we do not guarantee the specific performance levels of any machines. We guarantee that the machine you rent will operate as a foam-generating device, but make no claims beyond that. Renters should rely on their own familiarity with foam machines to make their decision. We urge you that when in doubt, rent a larger or multiple machines. People, temperature, water content, misinterpretation of instructions, and other factors can all lead to less foam generation.
The amount of foam that stays in a designated area can vary greatly, depending on factors such as temperature, humidity, type of water (hard or soft), floor surface and number of people dancing in foam. High temperatures, porous floors and large amounts of people will result in faster dissipation of foam. Foamalicious, Inc. makes no guarantees regarding the amount of foam generated or the length of time that foam will last in a dance floor environment.
You must protect your floors. Foam can damage anything that regular water will.
Rental price does not include shipping of foam fluid (unless otherwise stated). Foam fluid used in our foam machine(s) must be purchased from Foamalicious, Inc., other fluids will damage the foam machine. Foam fluid is non-returnable and must be purchased separately (unless otherwise stated). Any damage to machines, including scratches, dents, breakage or damage in shipping and/or usage shall be charged to the renter. Renter is responsible for retaining original packing material for return, and insuring all return shipments. Rental price covers cost of units for dates specified within this agreement. No refunds on all orders once they have been charged.
Foam machine(s) must be emptied, cleaned, dried and returned by date specified within this agreement. Additional rate of $175.00 per day will apply for all rentals returned after the specified return date. In the event that a unit is damaged, it must still be returned on time. Late fees will not be waived under any circumstances. Renter must insure return shipment for replacement value of the machine. In the event that the machine is destroyed or lost by the shipper, Renter will be liable for any and all damages. Must use authorized shipping company per Foamalicious. (e.g. FedEx and UPS)
All machines are rigorously tested by a team of two authorized technicians immediately prior to customer pick up or shipping. All Jets, Pumps, Machines and Connections thereto are guaranteed to be in working condition when they leave our warehouse. All parts are carefully packed and must be repacked the same way.
Foamalicious Foam Machines and rental equipment/products are property of Foamalicious. It is understood that the renter of Foamalicious property is not an Owner’s agent, servant of employee for any purpose, condition, or circumstance for/or in which the Foamalicious products is involved while being operated by renter.
Any discounted packages will incur a 4.5% processing fee on all orders placed on credit cards, PayPal, Venmo, Apple Pay.
No refunds on any foam pit(s) once the order has been placed.
Some rental orders many NOT include shipping either to or from and must be paid once the order is ready to ship to you/client.
The undersigned Customer has rented and/or purchased equipment from Chris Smooth Inc. Foamalicious, Inc. to provide a foam party at the Customer’s location of choice, on the date specified in consideration of the rental, and/or purchase to be provided by Chris Smooth Inc. Foamalicious, Inc. and in addition to the fee for the rental, and/or purchase to be paid to Chris Smooth Inc. by the Customer, the Customer agrees as follows:
- To release, discharge and forever hold harmless and to indemnify, Chris Smooth Inc. Foamalicious, Inc. its employees, affiliates, owner, agents and representatives from and against any and all claims, demands, damages, fees, actions, causes of action of whatever nature and costs and expenses, including attorney’s fees, whether in contract or in tort, in law or in equity, liquidated or un-liquidated, which may arise out of or relate in any way to the Event, expressly including personal injury of any nature or property damage that may be suffered or incurred, by the Customer, members of his or her family, and any and all guests, invitees, licensees, contractors or subcontractors, agents or representatives of Customer, and agrees that Chris Smooth Inc/Foamalicious, Inc. shall not be responsible in any way for any claims related to any such injury or damage.
- Foamalicious and/or Chris Smooth, Inc. carries an insurance policy for its services while Chris Smooth Inc. operators are on site and does not cover rentals. We require that Customer maintains a policy of insurance covering injury to persons and property occurring at Customer’s location of choice set forth in the paragraph above. An additional rider to customer’s location/party maybe issued at an additional cost. Please inquire with office for those details.
- Once your foam machine(s) has been charged zero refunds will be given. Insurance is provided on all shipments to insure damages while in transit. All shipments will require an authorized adult signature.
- All discounted orders maybe charged in advance. No refunds will be given once your card has been charged.
- You will be required to fill out a credit card form that will act as a security deposit for your foam machine rental.
By accepting these terms and conditions, you authorize Chris Smooth Inc. aka Foamalicious Inc to process your order. You ALSO authorize this charge if the Shipping and Billing addresses are not the same. Once your credit card has been charged NO refunds will be given.
